Section 1
This agreement
InMemory (inmemory.lk) is a Sri Lankan death notice and memorial service operated by Ziyan Junaideen, Colombo. These terms are the agreement between you and Ziyan Junaideen, referred to here as InMemory, and they apply whenever you use the site — whether you post a notice, leave a tribute, list a funeral business, or only read.
If you do not accept these terms, please do not use the service. Where you post on behalf of a funeral home or another organisation, you confirm you may accept these terms for it.
Section 2
Who may use InMemory
You must be at least 18 years old to create an account or post a notice. Anyone may read the site, and anyone with an account may leave a tribute.
Keep your account details accurate and your login to yourself. You are responsible for what is done through your account. Tell us straight away if you think somebody else has access to it.
Section 3
Posting a notice
When you post a notice you confirm that the death is real, that the details are true so far as you know them, and that you are authorised by the family — or are the person the family has asked — to publish them.
That authority matters more here than anywhere else on the site. A notice names living relatives, gives the times and places where they will be gathered, and is read by people who knew them. Publishing one without the family's knowledge is a serious thing to do.
- Only publish photographs you are entitled to publish, and that the family is content to see online.
- Do not publish home addresses of living people, national identity card numbers, bank details or anything else that would put the family at risk.
- Ask before naming a relative who may not wish to appear online. It is hard to undo once the page has been shared.
- Cause of death is the family's choice to include or leave out. It is never required.
Posting a notice is free for families and funeral homes. We will tell you clearly before we ever charge for anything, and nothing you have already posted becomes chargeable.
Section 4
Review and publication
Notices are checked by us before they appear. We do this to keep out duplicates, obvious errors and notices posted about somebody who is alive — not to edit how a family chooses to remember someone.
We may reject a notice, hold it while we ask a question, or ask for something to be corrected. We may also archive or remove a published notice where we have to, and we will tell the family why when we do.
We cannot independently verify a death, an address, a service time or a relationship. Please check the details with the family before travelling.
Section 5
Tributes and condolences
Tributes are held until the family approves them. The family may approve, hide or delete any tribute on their notice, and does not have to give a reason. We may also remove a tribute that breaks these terms.
Write as you would speak at the house. Grief is not a place for a dispute about property, an old quarrel, or a sales pitch.
Section 6
What you may not post
You may not post anything that is:
- false, misleading, or about a person who has not died;
- abusive, obscene, threatening, or intended to humiliate the deceased or their family;
- an attack on a person or group by race, religion, caste, ethnicity, gender, sexuality or disability;
- in breach of somebody else's copyright, privacy or other rights;
- advertising, a solicitation for donations we have not agreed to, spam, or an attempt to harvest contact details;
- unlawful in Sri Lanka, or in breach of a court order.
We may remove any of it without notice, and may suspend the account behind it.
Section 7
Your content stays yours
You keep ownership of everything you post — the words, the photographs and the tributes. Nothing here transfers ownership to us.
You give us permission to store, reproduce and display that content in order to run the service: to show the notice publicly, to include it in search results on the site, to generate the printable artwork and QR codes we offer, and to send the notifications people have asked for. That permission ends for future use when the content is removed, though copies may remain in backups for a period.
We do not sell your content, and we do not licence it to third parties for their own use.
Section 8
Corrections, transfers and removal
A family may correct a notice at any time. If a funeral home posted it, the family may ask for it to be transferred to them and the funeral home should not refuse.
If you are a close relative and want a notice corrected or taken down, write to us. We do not ask families to prove a relationship before acting on a removal request for a notice about their own relative — we would rather remove one notice too many than argue with a grieving family.
Notices stay online without a renewal fee. We do not delete a notice because it is old, and we do not charge to keep one up.
If you believe content on the site infringes your copyright, or was posted about you or your family without authority, use the report link on the notice or write to hello@inmemory.lk. Tell us which page, and what is wrong with it.
Section 9
Funeral homes and other businesses
Vendors listed on InMemory are responsible for the accuracy of their own listing, including prices, services and contact details. A listing is not a recommendation by us, and we do not inspect premises or verify licences.
Anything you arrange with a funeral home, florist or other supplier is a contract between you and them. We are not a party to it, we take no commission on it, and we cannot resolve a dispute about it — though we do want to hear if a business listed here has treated a family badly.
Claiming a listing means confirming you are authorised to act for that business. We may withdraw a listing or an account where a claim turns out to be false.
Section 10
Availability of the service
We work to keep the site up, particularly in the days around a funeral, but we cannot promise uninterrupted access. Maintenance, connectivity failures and events outside our control will sometimes interrupt it.
We may change, add or withdraw features. Where a change materially affects notices already published, we will give notice before it takes effect.
Section 11
Our responsibility, and its limits
The service is provided as it is. We do not warrant that content posted by families, visitors or funeral homes is accurate, complete or current, and we are not responsible for what any of them post.
To the extent the law allows, we are not liable for indirect or consequential loss, for loss arising from reliance on a service time or place published here, or for loss caused by content posted by another user. Nothing in these terms limits liability that cannot lawfully be limited.
Where we are found liable despite this, our total liability is limited to the amount you have paid us in the twelve months before the claim — which, for a family, is normally nothing.
Section 12
Suspension and closing an account
You may close your account at any time from your settings, or by writing to us. Notices you have published stay online unless you ask us to remove them, because other people rely on them.
We may suspend or close an account that repeatedly breaks these terms, that is used to impersonate a family, or that is used to harass people through tributes.
Section 13
Changes to these terms
We will update these terms as the service grows. Each version carries a version identifier and an effective date, and we record which version was accepted when a notice was submitted.
For a material change we will give notice on the site, and by email where we hold an address for you, before it takes effect. Continuing to use the service after that means you accept the new version.
Section 14
Governing law and how to reach us
These terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute arising from them.
Write to hello@inmemory.lk, or use the contact form. If your message concerns a funeral in the next day or two, say so at the top and we will move it to the front of the queue.
How we handle personal information
What we publish, what we keep private, and how a family can have something corrected or taken down.
